For Peter McGarry, he was ‘an intruder’.

A 53-year-old man has admitted to killing his dad. On Thursday, April 4, Peter McGarry made an appearance at Nottingham Crown Court, where he acknowledged killing his father Malcolm.

In his defence, James Horne KC stated that his client had no memory of what he had done since he had been using cocaine and alcohol, and he believed the person he had slain was just “an intruder.”

The sentencing hearing was postponed by Judge Stuart Rafferty to a later date in June. “Peter McGarry, you have pleaded guilty to the most serious offence that can be committed—namely murder,” the judge stated, remanding the prisoner into imprisonment.

“Life imprisonment is the only possible punishment, and that is what you will get. However, the minimum amount of time you have to spend before you can petition for parole must be taken into account by the court.

“Before I sentence you, I need to know as much as I can about you. A psychiatrist will see you. I understand from your justification for pleading that you don’t remember much about that evening.

On Friday, December 1, last year, at 12:55 a.m., police were summoned to Northfield Close, Sutton-in-Ashfield, where they discovered Mr. McGarry Sr. suffering from serious injuries. Despite receiving CPR (cardiopulmonary resuscitation) from emergency personnel, he was declared dead at 2:05 a.m.

After being taken into custody, his son, who lived on Kirkby-in-Ashfield’s Alexandra Street, was accused of killing him. Detective Inspector Melanie Crutchley, who is in charge of the investigation, made the following statement in a statement made available at the time of the charges: “We would like to once again offer our sincere condolences to Mr. McGarry’s family during this difficult time. Specialist family liaison officers are keeping them informed about the progress of our investigation.”
